Article 1. Definitions
In these General Terms and Conditions, the following definitions apply:

  1. HousingMatchers: the trade name and/or online service, operated by Ciceron B.V., located at Keizersgracht 520 H, Amsterdam, registered with the Chamber of Commerce under number [KvK-nummer], through which properties are presented.
  2. Visitor: any legal or natural person who uses the HousingMatchers Website to view property listings.
  3. Website: the website(s) of HousingMatchers, accessible via https://housingmatchers.nl and all underlying pages, where properties are presented.
  4. Property Listing/Offerings: a presentation of living space placed on the Website by or on behalf of HousingMatchers.

Article 2. Applicability

  1. These General Terms and Conditions apply to every use of the HousingMatchers Website.
  2. By visiting and using the Website, the Visitor declares to agree to these General Terms and Conditions.
  3. Deviations from these General Terms and Conditions are only valid if explicitly and in writing accepted by HousingMatchers.

Article 3. Services and Function of HousingMatchers

  1. HousingMatchers offers an online Website on which a selection of properties is presented.
  2. HousingMatchers does not act as a real estate agent or intermediary in any (rental) agreements arising from information on the Website. HousingMatchers only facilitates the presentation of property information. Any contact with providers of the listed properties and resulting agreements are concluded outside of HousingMatchers, without its direct involvement as a contracting party.
  3. HousingMatchers strives to present current and correct information but cannot give an absolute guarantee that Property Listings are always current, correct, complete, or available. Visitors should verify the information themselves with the respective provider.
  4. HousingMatchers cannot guarantee that Visitors will actually find suitable housing through the Website.

Article 4. Use of the Website

  1. The Visitor shall use the Website exclusively for legitimate informational purposes and shall refrain from any use that may be harmful, unlawful, or disruptive to the Website or to other Visitors.
  2. The Visitor is not permitted to use the Website in a manner that could damage the systems of HousingMatchers or third parties, such as spreading viruses or other harmful software.
  3. Systematic collection (scraping) of data from the Website is not permitted without the express written consent of HousingMatchers.

Article 5. Liability

  1. HousingMatchers offers the Website and the information presented thereon “as is”, without any guarantee regarding the accuracy, completeness, or timeliness of the Property Listings. HousingMatchers is not involved in the actual transactions between Visitors and any property providers.
  2. HousingMatchers is not liable for any direct or indirect damage, of any kind, arising from or related to the use of the Website or the inability to use the Website, including damage due to incorrect or incomplete information in the Property Listings.
  3. The Visitor is solely responsible for verifying information from the Property Listings (such as rent, availability, condition of the property, etc.) with the respective provider.
  4. HousingMatchers strives to keep the Website continuously accessible but does not guarantee uninterrupted availability. HousingMatchers is not liable for damage resulting from (temporary) unavailability of the Website.
  5. If, despite the above, HousingMatchers is held liable, its liability shall at all times be limited to what is legally permissible to the maximum extent.

Article 6. Intellectual Property Rights

  1. All intellectual property rights related to the Website, the name HousingMatchers, the associated logos, the software, the databases, texts, images, and other materials are exclusively held by HousingMatchers or its licensors.
  2. The Visitor is not permitted, without prior written permission from HousingMatchers, to copy, reproduce, distribute, publish, or otherwise exploit (parts of) the Website, the content, or the underlying software.

Article 7. Privacy and Data Processing

  1. HousingMatchers processes personal data of Visitors (such as IP addresses and cookie data for website analysis) in accordance with applicable privacy legislation, including the GDPR.

Article 8. Amendment of General Terms and Conditions

  1. HousingMatchers reserves the right to amend or supplement these General Terms and Conditions at any time.
  2. Amended terms will come into effect at the time they are published on the Website. By continuing to use the Website after the amendment, the Visitor is deemed to have accepted the amended terms. It is the Visitor's responsibility to regularly check the General Terms and Conditions.

Article 9. Applicable Law and Competent Court

  1. These General Terms and Conditions and all legal relationships between HousingMatchers and the Visitor are exclusively governed by Dutch law.
  2. Any disputes arising from or related to these General Terms and Conditions or the use of the Website will be exclusively submitted to the competent court in the district where HousingMatchers is located, unless the law mandatorily dictates otherwise.

Article 10. Final Provisions

  1. If one or more provisions of these General Terms and Conditions prove to be null and void, annullable, or otherwise unenforceable, the remaining provisions shall remain in full force and effect. In such a case, HousingMatchers will establish a new provision to replace the null or annulled provision, taking into account, as much as possible, the purpose and scope of the original provision.
